SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

10. Dispute Resolution
10.1 Informal Resolution

The parties agree to attempt to resolve the dispute informally for a period of thirty (30) days from the date of receipt of the written notice. YOU AND GREEN LANTERN PIZZA EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND. Disputes must be brought on an individual basis only. If for any reason a claim proceeds in court rather than through arbitration, you and Green Lantern Pizza each waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information, without first engaging in arbitration or the informal dispute resolution process described above.
